House painting warranties: what the law really covers

When paint starts to peel off a few months after work is completed, the homeowner's first question is usually always the same: "Is this still covered by warranty?" The answer is not always obvious, because house painting does not work like buying an appliance. Understanding it well, before signing any quote, prevents difficult discussions later.

What the law says about warranties on painting work

Painting as a contract of work

A painting job contracted to a professional is legally classified as a contract of work, regulated by the Civil Code. This means that if the work has defects (for example, paint applied over a poorly prepared surface), the contractor is responsible for correcting the problem, unless the repair costs would be disproportionate to the value of the service.

The deadlines that really matter

There are two distinct deadlines worth not confusing:

  • Deadline to report the defect: according to the general rule for work contracts, defects must be reported to the professional within 30 days of discovery. When painting is part of work on a property intended for long-term use, this reporting deadline extends to one year from the date the problem is detected.
  • Work warranty period: for properties intended for long-term use, the law provides a five-year period from the date of completion, during which defects related to execution faults can be reported.

In practice, this means that a "30-day" commercial warranty offered by a painter does not cancel the rights provided by civil law. It may even be shorter than what the customer is entitled to by law, especially when the defect results from poor surface preparation and not external causes such as active moisture.

What is typically NOT covered

Causes outside the painter's work

Not all problems after painting are the responsibility of whoever painted. It is important to distinguish:

SituationTypical responsibility
Paint peeling due to poor surface preparationThe painter's
Bubbles or stains due to pre-existing rising dampUsually not covered, unless the painter guaranteed prior treatment
Cracks caused by structural movement of the buildingOutside the scope of painting
Discoloration due to extreme sun exposure on facadesDepends on the paint used and what was agreed

If the house already showed signs of moisture before painting1, and that problem was not treated, it is natural that the paint will fail again, and this is usually not a defect attributable to the painter's work, but rather a pre-existing condition.

The role of moisture in claims

Portugal has a significant percentage of homes with moisture and infiltration problems, especially in older buildings near river areas or with poor ventilation, as recent data on the national housing stock shows. This means that before claiming a warranty, it is worth understanding whether the problem is really painting or whether it stems from an infiltration or condensation that needs to be treated first, as explained in our article about walls that refuse paint because of moisture2.

How to protect yourself before, during and after the work

Before starting

  1. Ask that the scope of work be recorded in writing, including which surfaces will be treated and what type of preparation is planned.
  2. Confirm that the professional is properly registered to provide the service. On our platform, this verification is always done before we present any professional as an option, confirming that they are registered as self-employed or have a registered company.
  3. Take photographs of the current state of the walls, especially areas with stains, cracks or old signs of moisture. This serves as proof of the initial state, useful for any future claim.

During and after the work

  • Keep a record of what was actually agreed. On our platform, the entire scope of work is recorded online, visible to both the customer and the professional and the platform, which prevents misunderstandings about what was or was not included.
  • Inspect the completed work, preferably in good natural light, to identify visible faults while it is still easy to associate them with the recent work.
  • If a problem arises, report it in writing (message, email or through the platform) as soon as possible, describing the exact location and attaching dated photographs.

What to do in practice if the paint fails early

If the paint starts to show problems a few weeks or months after completion, the first step is always to document, not to confront. A practical guide:

  1. Photograph the defect with good lighting, including a wide shot (to show the location) and a close-up (to show the detail).
  2. Review what was initially agreed: what paint was used, how many coats were planned, whether moisture treatment was included.
  3. Contact the professional in writing, within 30 days of detecting the problem, so that the communication counts as a formal report of the defect.
  4. If there is no satisfactory response, you can resort to the Complaints Book or consumer protection entities, such as DECO.

This sequence of steps is what really determines whether a claim has a chance of being accepted, much more than the number of days written on a commercial warranty paper.

Frequently Asked Questions

Yes, but it does not replace the rights provided by law. Even if the professional offers only 30 days of commercial warranty, this does not eliminate the longer deadlines provided in the Civil Code for defects in long-term works.

In practice, it is usually necessary to assess the history of the wall and the type of stain. If the moisture already existed before painting and was not treated, the painting warranty is unlikely to cover the problem; if it appears without previous signs, it is more likely to be an execution defect.

It is not required to have a formal written contract, but it is much easier to claim when there is a clear record of what was agreed. An exchange of messages or a detailed quote already serve as proof of what was agreed.

No. A quote per m² is always indicative, because two walls with the same area can have very different conditions, such as cracks or degraded plaster. The price is only confirmed after the real condition of the surfaces has been assessed, either through photos and videos or through a site visit.

It depends on the nature of the work, but the general rule provides 30 days to report the defect to the professional after its detection. In long-term works on properties, this reporting deadline can extend to one year, within the five-year warranty period.
